This privacy notice only refers to information collected by Learn Dutch in Maastricht.

We only have access to information that you voluntarily give us via email, through our online forms or other direct contact from you. We will not sell or rent this information to anyone. We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfil your request.

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

While we protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job are granted access to personally identifiable information. The computers/files in which we store personally identifiable information are kept in a secure environment.

 What student information do we collect and why do we use it?

  • We need to collect information from you when you book an Dutch course with us.

  • You will be asked for your name, nationality, and contact details.

  • During school activities, incidentally photographs may be taken of students. School photos may be used on our managed social media pages and marketing materials. We will not take photos of you if you express you don’t want to.

  • All your personal information and photos will be kept securely and only used:

    • to enrol you in our school,

    • to process transactions,

    • to help with visa applications (if applicable),

    • to officially promote Learn Dutch in Maastricht.

 

Learn Dutch in Maastricht requires permission to use this information or any photographs taken of you. You may request this data at any time or tell us to remove it from our school records unless it is kept for legal reasons.

We will ask you if you accept this privacy policy on our booking form. This can be withdrawn at any time.

What do we use your information for?

Any of the information we collect from you may be used in one of the following ways:

  • To personalize your experience (your information helps us to better respond to your individual needs).

  • To improve our school (we continually strive to improve our language programmes based on the information and feedback we receive from you).

  • To complete financial transactions.

  • Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of enrolling you on one of our language programmes, personalize your experience (course, social programme, accommodation) or officially promoting Learn Dutch in Maastricht.

Your personal data – what is it?

  • Personal data is information which can be used to identify you.

  • Identification can occur because of data controlled by Learn Dutch in Maastricht.

  • The processing of personal data is governed by the General Data Protection Regulations, GDPR.

Learn Dutch in Maastricht may collect and store:
Contact details; nationality; mother tongue; gender; payment information; course enrollment information; certificates; attendance; and school photos.

Learn Dutch in Maastricht is the data controller. This means Learn Dutch in Maastricht decides how and why your personal data is used and kept.

Learn Dutch in Maastricht complies with GDPR by keeping personal data up to date; by storing and destroying it securely; by not collecting or retaining excessive amounts of data; by protecting personal data from loss, misuse, unauthorized access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.

  • To provide our team with relevant information to successfully enroll students on our language programs.

  • To help our academic team and teachers place students in a class at the correct level.

  • To process financial transactions and operate the language school.

  • To maintain our student and employee files.

  • To maintain our own financial accounts.

  • To meet our accreditation requirements.

  • To assist non-EU students in applying for a student visas in The Netherlands.

  • To maintain attendance records.

  • To promote the school and communicate with students regarding events and news.

 

What is the legal basis for processing your personal data?

These fall under either article 6 or article 9 – dealt with separately below:

 Article 6 of GDPR- Lawfulness of processing

  • With the consent of the data subject

  • Processing is necessary for the performance of a contract with the data subject or to take steps to enter into a contract (see terms and conditions)

  • Processing is necessary for compliance with a legal obligation (financial records are kept to meet our legal tax obligations, student records are kept for administration purposes)

  • Processing is necessary for the legitimate interests of the data controller except where such interests are overridden by the interests, rights or freedoms of the data subject (to promote the language school and communicate information to students)

  • Explicit consent of the data subject

  • Processing is necessary for the establishment, exercise or defence of legal claims or where courts are acting in their judicial capacity (visa applications and visa requirements for non-EU students)

Sharing your personal data
Your personal data will be treated in the strictest confidence and will only be shared with relevant staff of Learn Dutch in Maastricht, to meet its legal requirements or, where applicable, with trusted partner organisations providing services such as social programme activities, medical care, insurance cover, visa application support, bank account opening, or immigration services. We will only share your data with other third parties with your express consent. 

 

How long do we keep your personal data?
In order to meet our operational obligations there is no time limit on how long we keep your personal data, unless you request your data to be removed from our system.

 

Your rights and your personal data
Unless subject to an exemption under GDPR you have the following rights with respect to your personal data:

  • The right to request a copy of your personal data which Learn Dutch in Maastricht holds about you;

  • The right to request that Learn Dutch in Maastricht corrects any personal data if it is found to be inaccurate or out of date;

  • The right to request your personal data is erased where it is no longer necessary for Learn Dutch in Maastricht to retain such data;

  • The right to withdraw your consent to data processing at any time;

Among the types of Personal Data that this Application collects, by itself or through third parties, there are: Cookies, first name, last name, country, email address, Usage Data, unique device identifiers for advertising (Google Advertiser ID or IDFA, for example) and phone number.

Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this Application.


Unless specified otherwise, all Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services. In cases where this Application specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service.


Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.
Any use of Cookies – or of other tracking tools – by this Application or by the owners of third-party services used by this Application serves the purpose of providing the Service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy, if available.

Users are responsible for any third-party Personal Data obtained, published or shared through this Application and confirm that they have the third party's consent to provide the Data to the Owner.

Mode and place of processing the Data

Methods of processing

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.
The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Owner at any time.

 

Legal basis of processing

The Owner may process Personal Data relating to Users if one of the following applies:

  • Users have given their consent for one or more specific purposes. Note: Under some legislations the Owner may be allowed to process Personal Data until the User objects to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of Personal Data is subject to European data protection law;

  • provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof;

  • processing is necessary for compliance with a legal obligation to which the Owner is subject;

  • processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Owner;

  • processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.

In any case, the Owner will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

 

Place

The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located. Data is stored in the STRATO & Outlook email mail box, Wix database, Bookeo scheduling app, and in Windows Excel sheets, which are stored and backed up in Dropbox.

Depending on the User's location, data transfers may involve transferring the User's Data to a country other than their own. To find out more about the place of processing of such transferred Data, Users can check the section containing details about the processing of Personal Data.

Users are also entitled to learn about the legal basis of Data transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data.

If any such transfer takes place, Users can find out more by checking the relevant sections of this document or inquire with the Owner using the information provided in the contact section.

 

Retention time

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.

Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.

  • Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.

The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

The Data concerning the User is collected to allow the Owner to provide its Services, as well as for the following purposes: Traffic optimization and distribution, Contacting the User, Analytics, Advertising, Remarketing and behavioral targeting, Interaction with external social networks and platforms, Displaying content from external platforms, SPAM protection, User database management, Managing contacts and sending messages, Interaction with live chat platforms, Interaction with online survey platforms, Platform services and hosting and Registration and authentication.

Advertising

This type of service allows User Data to be utilized for advertising communication purposes displayed in the form of banners and other advertisements on this Application, possibly based on User interests.
This does not mean that all Personal Data are used for this purpose. Information and conditions of use are shown below.


Some of the services listed below may use Cookies to identify Users or they may use the behavioral retargeting technique, i.e. displaying ads tailored to the User’s interests and behavior, including those detected outside this Application. This Application may use identifiers for mobile devices (including Android Advertising ID or Advertising Identifier for iOS, respectively) and technologies similar to cookies to run the Facebook Audience Network service. One of the ways Audience Network shows ads is by using the User's ad preferences. The User can control this in the Facebook ad settings.

By filling in the contact form with their Data, the User authorizes this Application to use these details to reply to requests for information, quotes or any other kind of request as indicated by the form’s header.

This type of service allows you to view content hosted on external platforms directly from the pages of this Application and interact with them.
This type of service might still collect web traffic data for the pages where the service is installed, even when Users do not use it.

Google Maps is a maps visualization service provided by Google Inc. that allows this Application to incorporate content of this kind on its pages.

This type of service makes it possible to manage a database of email contacts, phone contacts or any other contact information to communicate with the User.

These services have the purpose of hosting and running key components of this Application, therefore allowing the provision of this Application from within a unified platform. Some of these services work through geographically distributed servers, making it difficult to determine the actual location where the Personal Data are stored.

User database management

This type of service allows the Owner to build user profiles by starting from an email address, a personal name, or other information that the User provides to this Application, as well as to track User activities through analytics features. This Personal Data may also be matched with publicly available information about the User (such as social networks' profiles) and used to build private profiles that the Owner can display and use for improving this Application.
Some of these services may also enable the sending of timed messages to the User, such as emails based on specific actions performed on this Application.

The rights of Users

Users may exercise certain rights regarding their Data processed by the Owner.

In particular, Users have the right to do the following:

We occasionally choose to not publish a review on this website if we feel that it doesn't represent the student's experience, if the student has missed a lot of classes, or if we have suspicions that it's a fake review.
